Introduction

PLEASE READ THESE TERMS AND CONDITIONS (“TERMS”) CAREFULLY. This agreement governs your access to and use of FundEasy products and services, and applies to all users—regardless of role, level of access, or how you interact with the platform.

These Terms consist of the following documents:

  • General Terms: These provisions apply to all users and cover core legal and commercial terms such as intellectual property rights, disclaimers, and governing law.

  • Subscriber Terms: These include additional terms that apply specifically to organizations and their authorized users who access our services through a paid subscription.

  • Fundraiser Terms: These apply to authorized individuals who use certain features of our services to support a Subscriber’s fundraising efforts, including but not limited to team captains and table hosts.

  • Donor Terms: These apply to individuals who make contributions to campaigns or events hosted on the Service.

  • Privacy Policy: This explains how we collect, use, and share your personal information, and outlines your privacy rights.

  • Cookies Policy: This explains what cookies are, how we use them, and what choices you have in managing cookies on your device.

BY ACCESSING OR USING FUNDEASY PRODUCTS OR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, YOU MAY NOT ACCESS OR USE THE PLATFORM.

When you use our products or services, you are also agreeing to our Privacy Policy, which is incorporated into these Terms by reference. Please take the time to read through these documents carefully, as your continued use constitutes acceptance. Any supplemental terms, conditions, or policies posted to the site from time to time are also expressly incorporated herein by reference.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. When we do, we will update the “Last Updated” date at the top of this page. If we make material changes, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What qualifies as a “material change” will be determined in our sole discretion. Continued use of our products and services after the Terms are updated constitutes your acceptance of the revised Terms.

ATTENTION: These Terms contain a binding arbitration provision and a class action waiver. By using this website, you agree to resolve any disputes with FundEasy exclusively through arbitration and waive your right to sue in court in front of a judge or jury, except in small claims court. These provisions affect your legal rights—please read the Dispute Resolution section below carefully.

General Terms & Conditions

These General Terms apply to all users of FundEasy’s products and services (“Service”), including subscribers, fundraiser supporters, donors, event registrants, and visitors. Please review them carefully, as continued use constitutes acceptance.

1. Definitions

These are the key terms that you need to know that will be referenced throughout these Terms:

  • Account means a unique account created for you to access FundEasy’s Services or parts of the Services.

  • Affiliate means an entity that controls, is controlled by, or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest, or other securities entitled to vote for election of directors or other managing authority.

  • Application means the software program provided by the Company through its web-based platform under the name FundEasy (previously known as Ministry Sync), Attendance, Peer-to-Peer, and/or Crowdfunding, as well as the downloadable mobile application, Live Check-In.

  • Application Store means the digital distribution service operated and developed by Apple Inc. (Apple App Store) or Google Inc. (Google Play Store) in which the application has been downloaded.

  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Insite Technology, Inc., doing business as FundEasy, located at 2933 Chester King Rd. Cookeville, TN 38501.

  • Content means any materials, including text, images, data, or other information that you upload, input, or otherwise make available through the Service, including but not limited to guest lists, event branding, fundraising messaging, or campaign materials.

  • Device means any device that can access the Service such as a computer, a smartphone, or a digital tablet.

  • Event means any campaign, fundraiser, event, or other activity hosted through the Service that collects participant information, tracks engagement, and/or accepts donations or registrations.

  • Feedback means feedback, innovations, or suggestions sent by you regarding the attributes, performance, or features of the Service.

  • Promotions refers to contests, sweepstakes, or other promotions offered through or in connection with the Service.

  • Orders mean a request by you to purchase Service from us.

  • Service means the Company’s software, website, applications, and any related features or services provided to you under these Terms, which may include support.

  • Software License means the limited, non-exclusive, non-transferable, and revocable right granted to you to access and use the Service in accordance with these Terms.

  • Subscription Plan means any tier or level of access to the Service offered by FundEasy, including free, paid, trial, or promotional plans. Subscription Plans may differ in their features, duration, pricing, and permitted usage.

  • Terms and Conditions (also referred to as “Terms”) means this agreement that forms the entire contract between you and us regarding the use of the Service.

  • Third-party Service means any services or content (including data, information, products, or services) provided by a third-party that may be displayed, included, or made available by the Service.

  • User Data means any personal information, contact information, payment information, or other data associated with an individual that is collected, stored, or processed in connection with the Service. For more information, please refer to our Privacy Policy.

  • Website refers to the FundEasy website and/or application, accessible at https://www.fundeasy.com

  • You means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. This may include Subscribers, Fundraisers, Donors, or Visitors.

    • Subscriber means an organization that creates an account to access and use the Service under any Subscription Plan, whether free or paid.

    • Fundraiser means an individual authorized by a Subscriber to access certain features of the Service to support fundraising efforts on the Subscriber’s behalf.

    • Donor means an individual who contributes funds to a campaign hosted on the Service.

    • Visitor means any individual who visits the Fund Easy website or application without creating an account.

2. Access & Use of Services

This section outlines basic eligibility requirements, account responsibilities, acceptable use, and user rights in relation to the platform. Certain features may only be available depending on your subscription plan or method of access.

2.1 Eligibility and Acceptable Use

To access or use FundEasy products and services, You must:

  • Be at least 18 years old and capable of entering into legally binding contracts;

  • Provide accurate, current, and complete information during registration, and promptly update it as needed;

  • Represent and warrant that you have the legal right to use any credit card, debit card, or other payment method provided, and that the information you supply is true, correct, and complete;

  • Accept full responsibility for your use of the Service and for all activity under your account,

  • Maintain the confidentiality of your login credentials and notify us immediately of any suspected unauthorized access or security breach;

  • Comply with these Terms and all applicable laws, regulations, and financial reporting obligations.

By agreeing to these Terms, you further agree to:

  • Not use the platform for any unlawful, deceptive, or fraudulent purpose;

  • Not attempt to gain unauthorized access to any part of the FundEasy platform or its systems;

  • Not harvest scrape, or collect data about other users without their express permission;

  • Not impersonate any person or entity, or misrepresent affiliation with any person or entity;

  • Not use a username that is offensive, vulgar, obscene, or that violates another party’s intellectual property rights without proper authorization;

  • Not interfere with, disrupt, or attempt to bypass the platform’s security features or functionality;

  • Not post, transmit, or otherwise make available any content that is false, misleading, deceptive, offensive, or in violation of our Community Standards as listed in Section 2.5;

  • Not access the platform through automated or non-human means, including bots, scripts, or similar tools—unless explicitly authorized by us;

  • Not use any funds received or processed through the Service for purposes other than those disclosed to users at the time of solicitation or contribution.

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms. In the event of a dispute over account ownership, FundEasy will determine, in its sole discretion, the rightful account holder and our decision, which may include termination or suspension of the account, will be final and binding.

Note: Donors and website visitors are not required to create an account in order to use the Services. However, any information voluntarily provided (such as name, contact details, or payment information) is subject to and governed by our Privacy Policy.

  1. Customer Support

FundEasy maintains a Customer Support team to assist you in general use of the Company’s platform and associated services. Specifically, support agents are available to educate users on available features and provide troubleshooting assistance. This assistance may be provided via email (support@fundeasy.com), chat, and limited phone support and may include direct guidance or links to self-service resources such as training videos and help articles.

If you request support to perform tasks you are otherwise able to complete using the existing event tools, you will be charged for this work. Such non-standard requests are billed as follows:

  • $200/hour

  • Charged per 15-minute increment and rounded up to the nearest 15-minute interval;

  • Minimum of 30 minutes per request;

  • Charge is a per-request fee

Your approval will be requested before the Customer Support Team will complete any non-standard, billable tasks. Certain responsibilities may fall entirely outside the scope of the Customer Support team; in which case, you remain solely responsible for their completion.

2.3 Limited License to Use the Service

Subject to your continued compliance with these Terms, FundEasy grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for its intended purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service except as expressly permitted by these Terms or with our prior written consent.

2.4 User Content License

Each user of the Service grants us a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display any Content that they submit, post, or display through the Service throughout the world in any media. You retain any and all of your rights to any Content you submit, post, or display on or through the Service and you are responsible for protecting those rights. You represent and warrant that you have all necessary rights to grant this license and that your Content does not violate any third-party rights or applicable laws.

2.5 User Content Guidelines

Our Service allows you to post or submit Content. You are solely responsible for the Content you contribute, including its legality, reliability, and appropriateness.

You retain ownership of any Content you submit, but by posting it through the Service, you acknowledge and agree that it may be viewed, accessed, or shared by other users. You grant us the rights outlined in Section 2.4 to use your Content in connection with operating and promoting the Service, including making it available to others in accordance with these Terms. If you do not want your Content to be seen, copied, or used by others, do not post it.

Additionally, under these Terms, you agree that your Content will not (i) violate any law or regulation; (ii) contain any material that is deceptive, fraudulent, or misleading; (iii) include spam, unauthorized advertising, or chain letters; (iv) contain malware, viruses, or other harmful software; (v) infringe the intellectual property, privacy, or publicity rights of others; (vi) be intentionally abusive, harassing, defamatory, obscene, or designed to offend, or (vii) be offensive, inappropriate, or otherwise unacceptable to FundEasy, in its sole discretion.

To ensure a safe, respectful, and positive environment for everyone who uses our Services, all users must adhere to FundEasy’s Community Standards. These standards reflect our commitment to supporting charitable and mission-driven organizations, and they apply to any interaction on or through the Service, including posting Content, communicating with others, and participating in online events or fundraising activities.

Users are required to refrain from posting, uploading, or distributing any Content, including links to third-party websites or resources, that contains vulgar or profane language; sexual content or innuendo; sexually suggestive or explicit imagery; graphic, gratuitous, or celebratory depictions of violence or harm; or any content that demeans, insults, or targets individuals or groups for any reason. Additionally, users are strictly prohibited from posting, transmitting, or otherwise making available any content that solicits or attempts to collect personal information from anyone known or reasonably believed to be under the age of 18 or depicts, exploits, or references minors in any sexual, violent, or otherwise inappropriate manner.

We reserve the right, but are not obligated, to review, remove, or modify Content that we determine, in our sole discretion, violates the Terms, our Community Standards, or is otherwise inappropriate. We may suspend or terminate your access to the Service for posting such Content.

You understand that use of the Service may expose you to Content you find offensive, indecent, or objectionable. FundEasy is not responsible for user-submitted Content and will not be liable for any loss, damage, or harm resulting from your access to or reliance on such Content. Furthermore, while we may perform regular backups, we cannot guarantee that Content will not be lost, corrupted, or irretrievable. You are solely responsible for maintaining your own copies of any Content you value. We may offer support to troubleshoot backup issues but are not liable for the loss or corruption of Content or any failure to restore Content to a usable state.

If you encounter Content that appears to violate these guidelines, we encourage you to let us know.

2.6 Third-Party Login Services

You may have the option to register for or access the Service using your login credentials from a third-party social media service (e.g., Facebook). By doing so, you authorize FundEasy to access and use certain account information from that service, as permitted by its terms and privacy settings. 

Your use of any third-party login service is governed by the terms and privacy policies of that provider. You are solely responsible for maintaining the confidentiality of any credentials associated with your third-party account and for all activities that occur under your account, whether accessed via the Service directly or through a third-party integration. 

FundEasy is not responsible for the accuracy, availability, or security of such services, and disclaims any liability related to your use of them. Regardless of how you access the Service, you are subject to and bound by these Terms.

3. Intellectual Property & Copyright Policy

3.1 Ownership of the Service

The Service and all original materials and content made available by FundEasy, excluding user-submitted Content, are and will remain the exclusive property of the Company and its licensors, and are protected by copyright, trademark, trade secret, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

You may not use any FundEasy trademarks, logos, or trade dress without our prior written permission.

3.2 Copyright Infringement and DMCA Policy

We respect the intellectual property rights of others and expect users of the Service to do the same. It is our policy to respond to any claim that Content posted on the Service infringes a copyright or other intellectual property infringement of any person.

If you are a copyright owner, or authorized on behalf of one, and you believe that any content on the Service constitutes copyright infringement, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) via email to our designated Copyright Agent at: privacy@fundeasy.com.

Your notice must include the following information in writing (per 17 U.S.C. § 512(c)(3)):

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the copyrighted work;

  • A description of the copyrighted work that you claim has been infringed;

  • Identification of the allegedly infringing content and its location on the Service (including URL, if applicable);

  • Your contact information, including your name, address, telephone number, and email address;

  • A statement that you have a good-faith belief that the use of the content is not authorized by the copyright owner, its agent, or the law;

  • A statement made under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Please note that under Section 512(f) of the DMCA, you may be liable for damages, including attorneys’ fees and costs, if you knowingly misrepresent that content or activity is infringing.

We may remove or disable access to content alleged to be infringing and will, in appropriate circumstances, terminate the accounts of repeat infringers.

3.3 Feedback

If you submit any ideas, suggestions, proposals, or other feedback regarding the Service (“Feedback”), you acknowledge that such submissions are voluntary and grant FundEasy a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, disclose, sublicense, distribute, modify, and otherwise exploit such Feedback for any purpose, without restriction and without compensation or attribution to you.

4. Pricing & Orders

This section outlines the terms regarding pricing, ordering, and payment processing for the Service. For more detailed information on subscriptions and payments, please refer to our Subscribers Terms below.

4.1 Pricing

FundEasy reserves the right to modify its subscription pricing at any time in its sole discretion. Unless otherwise stated, any price changes will take effect at the start of your next billing cycle following notice from FundEasy.

In rare circumstances, FundEasy may adjust pricing mid-term due to factors outside its control, including changes in tax law, government action, foreign exchange fluctuations, or other events materially affecting the cost of providing the Service. In such cases, you will be notified and given the option to cancel your subscription before the changes take effect.

Your continued use of the Service after any pricing change becomes effective constitutes your agreement to the updated pricing.

4.2 Orders & Billing Information

To purchase a subscription, you must provide accurate and complete billing information, including your full name, address, contact details, and a valid payment method.

By submitting this information, you represent and warrant that: (i) any payment information you provide is true, correct, and complete; (ii) you are authorized to use the designated payment method; (iii) charges incurred by you will be honored by your payment provider; and (iv) you agree to pay all applicable fees, taxes, and charges associated with your subscription.

By submitting your payment information, you authorize FundEasy to share it with third-party payment processors (see Section 4.3) for the purposes of processing your order and managing your subscription.

All payments are non-refundable unless otherwise stated. You are responsible for any applicable taxes, currency conversion fees, or transaction charges applied by your financial institution. All fees are charged in U.S. Dollars unless otherwise specified.

Promotions or special offers available through the Service may be governed by separate terms. Please review any applicable promotion rules carefully, as in the event of a conflict between these Terms and the terms of a promotion, the promotion-specific terms will govern.

4.3 Payment Processor

We use third-party payment processors to handle all payment transactions securely.  Payments are subject to the terms, conditions, and privacy policies of the payment processor you use, in addition to these Terms. You should review the payment terms of any payment processor you use.

Our payment processor partners accept most major credit and debit cards issued by U.S. banks, as well as ACH payments. If you enroll in a FundEasy subscription plan, you authorize recurring charges to the payment method provided. These charges will continue until you cancel your subscription with written notice at least 30 days before the end of your current subscription term.

You are responsible for maintaining valid payment information. If a payment cannot be processed, you will be contacted and asked to update your payment method within two weeks. If payment is still unsuccessful after that period, your subscription will be automatically canceled through the payment processor, and you will lose access to your account.

FundEasy is not responsible for any errors or delays caused by the payment processor. 

5. Indemnity

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless FundEasy, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorneys’ fees) arising out of or related to: (i) your use of the Service (including any use by someone using your login credentials); (ii) your violation of these Terms or any applicable law or regulation; (iii) your content, data, or other materials submitted through the Service, including any allegation that such material infringes or misappropriates the intellectual property or other rights of a third party; or (iv) your interactions with third parties, including but not limited to other users, partners, and service providers.

FundEasy reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any such matter without the prior written consent of FundEasy.

6. Disclaimer of Warranties

This section limits what users can expect from the FundEasy Service and Website. By using the Service or Website, you accept these limitations.

6.1 No Warranties

The Service and Website are provided “as is” and “as available,” without any warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, FundEasy, on its own behalf and on behalf of its Affiliates and their respective licensors and service providers, expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as warranties arising from course of dealing or usage of trade. You assume all risk and responsibility for your use of the Service and Website.

6.2 Website Availability and Functionality

While we aim to maintain the availability and security of the Website, we cannot guarantee that it will always function as expected. FundEasy makes no warranty that the Website will (i) meet your requirements; (ii) be compatible with your devices, browsers, operating systems, or third-party software/services; (iii) remain uninterrupted, timely, secure, or error-free; or (iv) be free of viruses, malware, or other harmful components. You use the Website at your own risk and are solely responsible for any resulting damage to your device or data.

6.3 Service Availability and Performance

Without limitation to the foregoing, FundEasy makes no guarantees about the performance or results of using the Service, including but not limited to its ability to (i) operate without interruption, errors, or delays; (ii) be free of bugs or security vulnerabilities; (iii) be compatible with every browser, device, integration, or third-party service; or (iv) achieve specific outcomes, including but not limited to fundraising goals, donor engagement, or financial metrics.

6.4 Content and User Activity

Although FundEasy attempts to ensure the integrity and accuracy of the Service and Website, it makes no representations, warranties, or guarantees whatsoever as to their correctness, accuracy, or accessibility. It is possible that the Service or Website could include typographical errors, technical inaccuracies, or other errors and omissions, including descriptions, pricing, availability, and various other information. These materials could be inaccurate or become inaccurate as a result of development occurring after their respective dates. We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right but not the obligation to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. If you spot an error, please let us know so we can address it.

6.5 Links to Other Websites 

Our Service and Website may include links to third-party websites or services we do not own or control. As such, you agree that FundEasy is not responsible for their content, security, or privacy practices. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. If you use a third-party link, you do so at your own risk. We recommend you review the terms and privacy policies of any site you visit.

Some jurisdictions do not allow the exclusion of certain types of warranties or limitations on applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you. In such a case, the exclusions and limitations set forth in this section shall be applied to the greatest extent enforceable under applicable law.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUNDEASY, ITS AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND CONTENT OR SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICE OR WEBSITE, OR ANY CONTENT, MATERIALS, OR FUNCTIONS THEREOF. THIS INCLUDES, WITHOUT LIMITATION, DAMAGES FOR LOST PROFITS, LOSS OF BUSINESS, LOSS OF DATA, LOSS OF GOODWILL, COMPUTER FAILURE OR MALFUNCTION, OR THE COST OF SUBSTITUTE GOODS OR SERVICES, EVEN IF FUNDEASY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL FUNDEASY’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICE, OR THE WEBSITE EXCEED (A) THE AMOUNT YOU PAID TO US, IF ANY, IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100) IF YOU HAVEN’T PURCHASED ANYTHING THROUGH THE SERVICE.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU. IN SUCH CASES, LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Dispute Resolution

Please read this section carefully, as it affects your legal rights. 

If you have any issues or disputes with us, we encourage you to contact us directly so we can work together in good faith to resolve the matter. If we cannot reach a resolution after 30 days, you and FundEasy agree to resolve any such disputes through binding individual arbitration, rather than through court proceedings or jury trials, except as described below. This means both of us waive the right to sue in court or participate in a class action.

This arbitration agreement applies to all users of FundEasy and covers any claims or disputes relating to these Terms, your use of the Service, or the Website. By agreeing to these Terms, you consent to submit any such disputes to binding arbitration administered by a neutral arbitrator under the rules of the American Arbitration Association (AAA) or another recognized arbitration organization if AAA is unavailable. The arbitrator’s decision will be final and binding, subject to only limited judicial review under the Federal Arbitration Act (FAA), and judgment on the award may be entered in any court of competent jurisdiction.

While most disputes are handled through arbitration, there are situations where either party may choose to go to court instead, including (i) for eligible claims brought in small claims court, (ii) to seek temporary or preliminary injunctive relief in connection with unauthorized use of intellectual property (such as trademarks, copyrights, or trade secrets), or (iii) to obtain immediate court intervention where necessary to prevent imminent and irreparable harm.

Notice Requirements. Before initiating arbitration, you must send an individualized Notice of Dispute to 538 Canal St Ste 319, New Smyrna Beach, FL 32168. We will do the same if we have a dispute with you. This notice is a prerequisite to arbitration and must describe the nature of the dispute, the relief requested, and any other relevant details. Please include your name, phone number, email address, mailing address, and relevant account information. Both you and FundEasy agree to attempt in good faith to resolve the dispute within 30 days of receipt of the notice before proceeding to arbitration.

Arbitration Procedure. Unless we both agree otherwise, arbitration will be conducted in English by a single arbitrator and may occur remotely (via phone or video conference) or at a mutually agreed location. Each party will bear its own costs and attorney’s fees, except as may be awarded by the arbitrator. Any claim or dispute related to these Terms, your use of the Service, or the Website must be brought within one (1) year from the date the issue first arose. After that time, no claims can be made. If any part of this section is found unenforceable, that portion will be handled in court, and the remainder of the dispute will proceed through arbitration. Both parties agree to submit to the personal jurisdiction of the court for any claims that cannot be arbitrated.

Class Action Waiver. By agreeing to these Terms, you agree that each of us can only bring claims against the other as individuals. This means that neither you nor us can participate in or bring class actions, collective actions, or any other type of representative action against the other. Furthermore, we both waive our rights to join or consolidate claims with others in any lawsuit, arbitration, or other proceeding. Any dispute between us must be resolved on an individual basis only, and we may only seek or obtain individualized relief. If any portion of this waiver is found to be unenforceable for a particular claim or type of relief, only that part will be severed, and the rest of the claims will still be subject to arbitration.

9. Choice of Law

The laws of Tennessee, excluding its conflicts of law rules, shall govern these Terms and your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.

10. Changes to the Terms

We may update or modify these Terms from time to time in our sole discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days’ notice prior to any new terms taking effect. What qualifies as a “material change” will be determined in our sole discretion.

By continuing to access or use the Service or Website after the updated Terms become effective, you agree to be bound by the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and Website.

11. Our Right to Refuse, Suspend, or Terminate Access

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

12. Notices 

Any notices (i) to us shall be given by certified mail addressed to FundEasy, 538 Canal St Ste 319, New Smyrna Beach, FL 32168 or by email to privacy@fundeasy.com; or (ii) to you at the e-mail address provided to us by you. 

Notices shall be deemed to have been given 24 hours after the e-mail was sent, unless we are notified that the e-mail address is invalid, in which event we may give notice by email or, if applicable, any postal mail at the address provided to us by you upon registration. Notice given by postal mail shall be deemed to have been given three (3) business days after the date of mailing.

13. Communications and Marketing

By using the Service, you consent to receive transactional and service-related communications from FundEasy, including account notifications, administrative messages, and updates required to fulfill your transactions or comply with applicable law. These communications are considered necessary for the operation of the Service and may not be opted out of.

You may also receive marketing or promotional communications from FundEasy, including newsletters, product announcements, and fundraising appeals. You may opt out of receiving such promotional messages at any time by following the unsubscribe instructions included in the message.

All commercial electronic messages sent to users in Canada comply with the Canadian Anti-Spam Legislation (CASL), including clear identification of the sender and a functioning unsubscribe mechanism.

14. General

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the rest of the Terms will remain in full force and effect.

These Terms constitute the entire agreement between you and FundEasy regarding your use of the Service and Website. You may also be subject to additional terms that apply to specific features, services, or tools offered by the Company.

Our failure to enforce any part of these Terms is not a waiver of our right to enforce that or any other part in the future. A waiver of any breach does not waive any later breach.

Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between you and FundEasy.

Any claim or cause of action related to your use of the Service or Website must be commenced within one (1) year after the claim or cause of action arose.

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms without restriction. These Terms will bind and inure to the benefit of each party’s successors and permitted assigns.

Section titles are for convenience only and have no legal effect.

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, labor conditions, governmental actions, internet failures, or power outages.

Any section of these Terms that by its nature should survive termination will survive, including but not limited to disclaimers of warranties, limitations of liability, dispute resolution, and indemnification.

California Residents

If any complaint with us is not satisfactorily resolved through our support channels, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

European Union (EU) Users

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident.

United States Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) you are not listed on any United States government list of prohibited or restricted parties.

Translation Interpretation

These Terms may be made available in languages other than English. In the event of any conflict between a translated version and the English version, the English version shall control.

Subscribers

These Subscriber Terms apply to organizations that create an account with FundEasy to manage Events and access other available tools and services. These terms supplement the General Terms and address responsibilities, subscription obligations, and usage expectations specific to these users.

1. Subscriptions

1.1 Subscription Plans

Your organization's access to the Service is governed by the specific Subscription Plan you select. Subscription features and administrative permissions may vary depending on your plan type and your assigned role within the organization.

Each paid Subscription Plan is for a term of one (1) year, regardless of whether you elect to be billed monthly or annually. Monthly billing is offered solely as a payment convenience and does not alter the full-year commitment. By enrolling in a subscription, you acknowledge responsibility for the entire annual fee for the duration of the term. The term begins on the subscription start date. 

We reserve the right to refuse or cancel your subscription at any time for certain reasons, including but not limited to fraud, abuse of the platform, or violations of these Terms.

1.2 Subscription Billing

All payments for paid Subscription Plans are processed through our designated payment processor. Please refer to Section 4 of the General Terms for the most current information on pricing, billing procedures, and the applicable payment processor. If the payment method on file fails, the terms outlined in Section 4.3 of the General Terms will apply.

1.3 Subscription Renewal

Paid Subscription Plans automatically renew at the end of each term unless canceled in accordance with these Terms. Renewal charges will be processed using the payment method on file.

We will send a reminder email before your renewal date. If you do not wish to renew, you must provide written notice of cancellation at least thirty (30) days before the end of your current subscription term.

1.4 Subscription Cancellation

All paid subscriptions maintain a one-year commitment, regardless of whether payment is made annually or monthly. If you cancel your subscription, you remain responsible for payment of the full annual term.

If you have subscribed with an annual payment, it will not renew upon your cancellation. No refund will be issued for any unused portion of the subscription. 

If you have subscribed with monthly payments, the remaining balance for the annual term will be charged in full upon cancellation. You will not be entitled to a refund of any fees paid upon cancellation.

To avoid automatic renewal, your cancellation request must be received at least thirty (30) days before the end of your current subscription term. If no such notice is received, your subscription will automatically renew for another one-year term at the then-current pricing.

Following cancellation, your organization will lose all access to its data. Any funds raised prior to cancellation will be transferred to your organization. However, you will no longer be able to create or host fundraising events on the platform.

1.5 14-Day Money Back Guarantee

If you are a first-time subscriber, you may cancel your subscription within fourteen (14) days of the subscription start date and receive a full refund of subscription fees paid, provided you have not used the Service to execute any events or campaigns. If you have launched an event or campaign, including opening any event for registration, the guarantee is void and no refund will be issued. In such cases, the event will be closed and can no longer be used. To cancel within this window, you must contact the Company to notify us of your intent to cancel. This guarantee applies only to brand new subscriptions and does not apply to renewals, plan upgrades, or downgrades.

2. Event Creation, Access, and Responsibility

There is no limit to the number of events your organization may create, but the specific tools and functionalities available to you may vary based on your Subscription Plan. Your organization is solely responsible for the content associated with any event, including event names, descriptions, images, and beneficiary details. You must ensure that all content complies with applicable law and with the standards set forth in Sections 2 and 3 of the General Terms.

FundEasy reserves the right to disable, remove, or restrict access to any event that violates our policies, disrupts Service operations, or poses a legal or reputational risk to the Company or its users.

3. Data Access and Usage Responsibilities

3.1 Data Access

Access to data within the Service is permission-based and varies according to your organization’s subscription plan and assigned user role assignments. It is your responsibility to manage these permissions, ensure that only authorized personnel have access to sensitive or confidential information, and confirm that all users comply with your internal policies and applicable laws.

FundEasy is not responsible for unauthorized access, misuse, or disclosure of data by individuals within your organization or by those to whom you grant access.

3.2 Data Usage and Retention

Your organization retains ownership of the data you collect through the Service, including information about donors, event participants, and other stakeholders. You are solely responsible for the integrity, accuracy, legality, and use of such data, and for complying with all applicable privacy, data protection, and communications laws.

If you export data from the Service for use outside the platform, you are responsible for safeguarding that data and ensuring its use remains lawful and secure. This includes, but is not limited to, protecting exported data against unauthorized access, use, or disclosure, and maintaining any necessary consents from individuals whose data is included. FundEasy disclaims all liability for data once it has been exported.

Misuse of data, including unauthorized access, improper sharing, or use outside the scope of your organization’s legitimate operations, may result in suspension or termination of access to the Service. In serious cases, FundEasy may take legal action or notify appropriate authorities as required by law.

Upon cancellation or expiration of your subscription, your organization will lose all access to its data immediately. We may delete your data, except where retention is required to meet legal obligations or enforce our rights. 

As a reminder, your organization’s use of the Service remains subject to acceptable use and compliance provisions as outlined in the General Terms, including obligations relating to truthful content, lawful conduct, and respectful use of the platform. You are responsible for ensuring that your staff and volunteers comply with these expectations.

4. Donations

Donations raised through FundEasy fundraising campaigns are processed by a third-party payment processor (“Payment Processor”). To withdraw funds raised through a campaign, either the organizer or, if different, the beneficiary (together, the “Withdrawing Entity”) must provide the Payment Processor with a valid bank account (“Withdrawing Account”) and any other information required to complete the transfer.

By submitting this information, the Withdrawing Entity represents and warrants to both FundEasy and the Payment Processor that the information provided is accurate and that they are authorized to use the designated Withdrawing Account.

By creating a fundraising campaign or accepting the role of beneficiary, the Withdrawing Entity authorizes the Payment Processor to process, use, transfer, and disclose relevant data in accordance with these Terms and the Payment Processor’s applicable terms and privacy policy. 

Fundraisers

These Fundraiser Terms apply to individuals who support an organization’s fundraising efforts by using the Service to create, promote, or manage events or campaigns, including but not limited to acting as a team lead in a peer-to-peer fundraiser, hosting a table at a gala, or helping organize a donation drive. These individuals (“Fundraisers”) use the Service at the invitation of a subscribing organization (“Subscriber”) and are granted limited access to certain platform features to support that organization’s campaigns.

1. Account Access and Usage

Fundraisers do not control or own any part of the Subscriber’s account or subscription. Access is provisioned by the Subscriber and may be modified or revoked at any time by the Subscriber or FundEasy. Fundraisers are expected to use the Service solely in support of the Subscriber’s campaign activities and in accordance with the General Terms, including those governing acceptable use, prohibited conduct, and platform integrity.

2. Data Access and Usage

Fundraisers must comply with all applicable laws, including privacy, data protection, and communications laws, when using the Service. You are responsible for ensuring that any information you collect, share, or act upon in connection with your fundraising activity is handled appropriately. You may not use donor information for any personal, commercial, or unrelated purposes. Misuse of data may result in suspension of your access or other legal consequences.

FundEasy disclaims all responsibility for the conduct of Fundraisers, including the content you post, the communications you send, and the methods you use to solicit donations. All such activity is undertaken on the Fundraiser’s own initiative or at the direction of the Subscriber. Access may be suspended or revoked without notice if a Fundraiser’s conduct violates these Terms, the Subscriber’s policies, or applicable law.

Donors

These Donor Terms apply to individuals (“Donors”) who make contributions through fundraising campaigns, widgets, or donation pages facilitated through the Service. By making a donation, you agree to these terms, which supplement the General Terms.

1. Eligibility and Information Accuracy

By submitting a donation, paying a registration fee, or engaging in any monetary contribution through the Service, you represent and warrant that (i) you are of legal age and have the capacity to enter into a binding contract; (ii) all information you provide is truthful, complete, and accurate; (iii) you are authorized to use the payment method submitted; and (iv) you are not using the Service for any fraudulent, unlawful, or unauthorized purpose. 

These requirements are further detailed in Section 2.1 Eligibility and Acceptable Use of the General Terms.

2. Payment Processing and Disputes

Donations made through the Service are processed by third-party payment processors. By donating, you agree to be bound by the applicable terms and privacy policies of the processor. FundEasy may handle or store payment information, but any issues, disputes, or chargebacks related to your donation must be resolved directly with the payment processor.

Unless expressly stated otherwise, donations are non-refundable. If you believe a donation was made in error, or wish to request a refund, you must contact the organization directly. FundEasy does not issue refunds and assumes no responsibility for refund processing or resolution.

3. Tax Receipts 

FundEasy facilitates certain automatic donation acknowledgments via email for online donations made through the Service, including receipts that may meet tax substantiation requirements, providing that the organization has entered required information (such as a tax ID or EIN) during event setup. However, FundEasy does not guarantee that such emails will meet legal standards for tax receipts in any jurisdiction.

Responsibility for ensuring that donors receive appropriate tax documentation ultimately rests with the Subscriber. Donors should directly contact the organization that received their contribution with any questions about tax deductibility, documentation, or receipt content.

4. Campaign and Nonprofit Verification

FundEasy requires all new nonprofit accounts to submit IRS determination documentation from an email address associated with the organization to verify their tax-exempt status. However, FundEasy does not independently review or approve individual fundraising events or campaigns created by nonprofit Subscribers. Donors are encouraged to conduct their own due diligence before making a contribution. FundEasy makes no representations about how donations will be used and does not guarantee any specific outcome.

5. Disclaimers and Limitations of Liability

Donations made through the Service are submitted at your own risk. FundEasy disclaims all warranties, express or implied, to the fullest extent permitted by law. We do not control or guarantee the accuracy, security, or content of Subscriber campaigns or their websites, and we are not responsible for the actions or communications of any Subscriber or Fundraiser. We are also not liable for any data loss, financial loss, or other harm resulting from your use of third-party services, including payment processors.

Cancellation of contract and any applicable penalties

You may terminate your Agreement with Stripe by closing your Stripe account at any time by following the instructions on Stripe’s website in your Account Profile. Stripe may terminate this Agreement and close your Stripe account at any time for any reason effective upon providing you notice in accordance with their Agreement. There are no penalties for termination. However, termination does not alter your liability for processed payments or related chargebacks.

Your Right to Post Content

Our Service allows You to post Content. You are responsible for the Content that You post to the Service, including its legality, reliability, and appropriateness.

By posting Content to the Service, You grant Us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Service. You retain any and all of Your rights to any Content You submit, post or display on or through the Service and You are responsible for protecting those rights. You agree that this license includes the right for Us to make Your Content available to other users of the Service, who may also use Your Content subject to these Terms.

You represent and warrant that: (i) the Content is Yours (You own it) or You have the right to use it and grant Us the rights and license as provided in these Terms, and (ii) the posting of Your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Content Restrictions

The Company is not responsible for the content of the Service's users. You expressly understand and agree that You are solely responsible for the Content and for all activity that occurs under your account, whether done so by You or any third person using Your account.

You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene or otherwise objectionable. Examples of such objectionable Content include, but are not limited to, the following:

Unlawful or promoting unlawful activity.

Defamatory, discriminatory, or mean-spirited content, including references or commentary about religion, race, sexual orientation, gender, national/ethnic origin, or other targeted groups.

Spam, machine – or randomly – generated, constituting unauthorized or unsolicited advertising, chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling.

Containing or installing any viruses, worms, malware, trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of any software, hardware or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of a third person.

Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity or other rights.

Impersonating any person or entity including the Company and its employees or representatives.

Violating the privacy of any third person.

False information and features.

The Company reserves the right, but not the obligation, to, in its sole discretion, determine whether or not any Content is appropriate and complies with these Terms, refuse or remove this Content. The Company further reserves the right to make formatting and edits and change the manner of any Content. The Company can also limit or revoke the use of the Service if You post such objectionable Content.

As the Company cannot control all content posted by users and/or third parties on the Service, you agree to use the Service at your own risk. You understand that by using the Service You may be exposed to content that You may find offensive, indecent, incorrect or objectionable, and You agree that under no circumstances will the Company be liable in any way for any content, including any errors or omissions in any content, or any loss or damage of any kind incurred as a result of your use of any content.

Content Backups

Although regular backups of Content are performed, the Company does not guarantee there will be no loss or corruption of data.

Corrupt or invalid backup points may be caused by, without limitation, Content that is corrupted prior to being backed up or that changes during the time a backup is performed.

The Company will provide support and attempt to troubleshoot any known or discovered issues that may affect the backups of Content. But You acknowledge that the Company has no liability related to the integrity of Content or the failure to successfully restore Content to a usable state.

You agree to maintain a complete and accurate copy of any Content in a location independent of the Service.

Copyright Policy

Intellectual Property Infringement

We respect the intellectual property rights of others. It is Our policy to respond to any claim that Content posted on the Service infringes a copyright or other intellectual property infringement of any person.

If You are a copyright owner, or authorized on behalf of one, and You believe that the copyrighted work has been copied in a way that constitutes copyright infringement that is taking place through the Service, You must submit Your notice in writing to the attention of our copyright agent via email at privacy@fundeasy.com and include in Your notice a detailed description of the alleged infringement.

You may be held accountable for damages (including costs and attorneys' fees) for misrepresenting that any Content is infringing Your copyright.

DMCA Notice and DMCA Procedure for Copyright Infringement Claims

You may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.

  • A description of the copyrighted work that You claim has been infringed, including the URL (i.e., web page address) of the location where the copyrighted work exists or a copy of the copyrighted work.

  • Your address, telephone number, and email address.

Upon receipt of a notification, the Company will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the Service.

The Service and its original content (excluding Content provided by You or other users), features and functionality are and will remain the exclusive property of the Company and its licensors.

The Service is protected by copyright, trademark, and other laws of both the Country and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

Your Feedback to Us

You assign all rights, title and interest in any Feedback You provide the Company. If for any reason such assignment is ineffective, You agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty free, worldwide right and licence to use, reproduce, disclose, sub-licence, distribute, modify and exploit such Feedback without restriction.

Our Service may contain links to third-party web sites or services that are not owned or controlled by the Company.

The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise You to read the terms and conditions and privacy policies of any third-party web sites or services that You visit.

Termination

We may terminate or suspend Your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately. If You wish to terminate Your Account, You may simply discontinue using the Service.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms and Your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by You through the Service or 100 USD if You haven't purchased anything through the Service.

To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data or other information, for business interruption, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Service, third-party software and/or third-party hardware used with the Service, or otherwise in connection with any provision of this Terms), even if the Company or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

Some states do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply. In these states, each party's liability will be limited to the greatest extent permitted by law.

"AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to You "AS IS" and "AS AVAILABLE" and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its Affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Service, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Important Note About Subscribers and Their Representatives

In these cases, the Subscriber determines what information is collected and how it is used, while FundEasy processes the information solely to provide the Service and is not responsible for the Subscriber’s privacy or data practices.

Any Personal Information you choose to provide to a Subscriber or its representatives is governed by that organization’s own privacy policies and applicable laws, not by this Privacy Policy. Subscribers are responsible for complying with applicable privacy and data protection laws with respect to the information they collect through the Service. We encourage you to review the applicable organization’s privacy practices before submitting Personal Information to them.

Definitions

The following definitions apply for purposes of this Privacy Policy. These terms have the same meaning whether used in singular or plural form. Capitalized terms that are not defined below have the meanings assigned to them in the FundEasy Terms & Conditions.

  • Tracking Technologies means cookies, pixels, tags, scripts, beacons, and similar tools used to collect information about your interactions with the Service for purposes such as security, functionality, analytics, performance measurement, or advertising.

  • Usage Data means information collected automatically when you use the Service or Application, including device and browser information, IP address, interaction data, diagnostic information, and other technical data generated by your activity on the Service.

    • Payment card and bank account numbers are collected and processed directly by our third-party payment processor. FundEasy does not store full payment card or bank account numbers. We may receive limited information from the processor—such as the last four digits of a card, the type of payment method, billing ZIP code, and transaction status—to manage your subscription and keep your Account active.

  • Communications, such as messages, inquiries, and other information you submit when you contact us or request support.

  • Event and Fundraising Information such as guest lists, participant details, registration information, or campaign content submitted through the Service. This information is processed by FundEasy on behalf of the Subscriber that created the event or fundraiser.

Usage Data

We automatically collect certain information when you use the Service (“Usage Data”). This information helps us operate, secure, and improve the Service. Usage Data may include:

  • Device and browser information, such as your IP address, browser type and version, operating system, and device identifiers.

  • Service activity information, such as the pages or features you access, the time and date of your visits, the time spent on pages, and interaction data.

  • Log and diagnostic information, including error logs, performance data, and other technical information generated by the Service.

  • Mobile-specific information, such as your device type and operating system when accessing the Service or Application.

  • Interaction analytics, such as click behavior, scroll depth, and navigation patterns, collected through third-party analytics tools such as Google Analytics, ContentSquare, Meta Pixel, or similar technologies.

We may also collect information that your browser or device automatically sends when you visit or interact with the Service.

Information from Third-Party Login Services

The Service may allow you to register for or access your Account using login credentials from a third-party service (such as a social media or identity-provider account). If you choose this option, we may receive certain information associated with your account on that service, such as your name, email address, or other information the third-party service makes available based on your privacy settings. Any information we receive from a third-party login service will be handled in accordance with this Privacy Policy. Your use of that service is governed by its own terms and privacy practices.

Information Collected While Using the Application

The Application may require access to certain device functions in order to support attendance tracking, guest check-in, and other event-related features. When you use the Application, you may be asked to grant permission for the Application to store or retrieve event data on your device or to enable other functionality necessary for its operation, such as providing access to your device’s camera to scan QR codes for guest check-in. The Application does not store images or video captured through your device’s camera.

Any information collected through the Application is used only to operate, maintain, or improve the features you choose to use. This may include downloading event data to your device, updating attendance records, and uploading that information back to FundEasy. The Application does not access device data for advertising or cross-site tracking purposes.

You may enable or disable permissions at any time through your device settings; however, some features may not function properly without the necessary permissions.

We use cookies and similar technologies to operate and improve the Service, understand how users interact with the Website, and remember your preferences. Cookies are small data files stored on your device. Some cookies are deleted when you close your browser (“session cookies”), while others remain on your device until they expire or you remove them (“persistent cookies”).

Information that you choose to make public is not subject to the same privacy protections as other Personal Information collected through the Service. By using features that publish information publicly, you are directing FundEasy to display that information to the public.

FundEasy may share Personal Information with the following categories of third parties:

  • Service Providers: We may share information with vendors who assist in operating the Service, including hosting, infrastructure, analytics, customer support, email delivery, security, and data processing. These providers may only use Personal Information as instructed by FundEasy.

  • Payment Processors: Third-party payment processors that handle subscription billing and payment transactions. FundEasy may handle or store payment information, but any issues, disputes, or chargebacks related to your donation must be resolved directly with the payment processor. At this time, FundEasy uses Stripe as its primary payment processor. Information about Stripe’s privacy practices is available at https://stripe.com/privacy. Payment processing is subject to the payment processor’s own terms and privacy policies, which we encourage you to review.

  • Subscribers: If you participate in an event, fundraiser, or campaign hosted by a Subscriber, FundEasy may share your registration information, donation information, or event-related details with that Subscriber as needed to administer the event. The Subscriber’s privacy practices—not this Privacy Policy—govern their use of that information.

  • Analytics Partners: We use third-party analytics tools (such as Google Analytics, ContentSquare, and similar technologies) that collect Usage Data to help us understand how users interact with the Service and improve usability and performance.

  • Advertising Partners: We use third-party advertising platforms (such as Meta or Google) to measure or optimize our advertising campaigns. These partners may receive information about your interactions with the Website for advertising measurement purposes. FundEasy does not sell Personal Information.

  • Business Transfers: Personal Information may be transferred as part of a merger, acquisition, financing, reorganization, or sale of FundEasy’s assets, subject to applicable law.

FundEasy is based in the United States, and the Personal Information we collect may be processed and stored in the United States or in other locations where FundEasy or its service providers operate. Any transmission of Personal Information over the Internet is done at your own risk. FundEasy is not responsible for circumvention of any privacy settings or security measures contained on the Website, Service, or Application.

Please note that opting out through one browser or device does not automatically apply to others. FundEasy does not sell Personal Information.

Where required by law, we will honor your opt‑out choices and any legally recognized browser or device‑level signals regarding sale/sharing and targeted advertising for the browser or device that sends the signal.

Do Not Sell or Share My Personal Information

FundEasy does not sell Personal Information for monetary consideration. However, under certain U.S. state privacy laws, some disclosures of Personal Information to advertising or analytics partners for purposes such as measuring advertising performance or improving marketing effectiveness may be considered a “sale” or “sharing.”

Children’s Privacy

The Service is intended for use by individuals who are at least 18 years old. FundEasy does not permit children under the age of 18 to create accounts or use the Service directly. Additionally, FundEasy does not knowingly collect Personal Information directly from children under the age of 13 without verifiable parental consent, as required by the U.S. Children’s Online Privacy Protection Act (“COPPA”). 

In some cases, Personal Information relating to children under the age of 18 may be provided by adult users (such as parents, legal guardians, or authorized representatives of a Subscriber) in connection with events, registrations, or fundraising activities facilitated through the Service. In these situations, the adult submitting the information represents that they have the authority and any required consent to do so, and is responsible for ensuring compliance with applicable privacy laws.

If FundEasy becomes aware that it has collected Personal Information directly from a child under 13 without appropriate parental consent, we will take reasonable steps to delete that information promptly.

A parent or legal guardian who has provided consent for the collection of a child’s Personal Information may request access to, correction of, or deletion of that information by contacting us using the information provided below. Withdrawal of consent may limit a child’s ability to participate in certain events or activities facilitated through the Service.

Do Not Track Signals
